    Jackson’s Kennel ​Stud​ ​Contract
     Jackson’s Kennel offers stud service to approved bitches only. The requirements are nonnegotiable. With stud service the Owner will be provided a copy of the pedigree, copy of the signed contract, links to the stud's health testing, and one profile picture and one stacked picture of the stud. Progesterone testing is highly encouraged to optimize ovulation timing and required for a rebreeding. Bitches left with the breeder to cover their breeding window must be tame, a bite-free history, current on Parvo, Distemper and Kennel Cough vaccines, as well as current on deworming. The bitch must be fit, healthy, breed standard, and under control at all times. 

    Bitches must be:
    • Minimum age 2 years old, maximum age 6 years old
    • Be Brucellosis negative, Canine Herpes Virus and symptoms free and free of Canine Papilloma Virus symptoms 
    • Be current on vaccinations including Parvo, Distemper, Kennel Cough/Bordetella, and Rabies
    • May carry 1 gene of VWD and not be affected genetically
    • Be of breed standard height, color, disposition
    • Be in good health and of a healthy weight
    • Be of sound temperament and personality
    • Display no signs of reactiveness or aggression to people or animals

    Please be aware pregnancy is not guaranteed. Pregnancy is a complicated process and anything can happen to compromise a pregnancy (from insufficient diet to environmental or accidental exposure). A litter is considered one live puppy at birth. Jackson’s Kennel is not responsible for, but not limited to, miscarriage, spontaneous abortion, and premature birth of the litter, partial or whole. Should the bitch fail to become pregnant due to illness, trauma, injury or other conditions due to exposure to other dogs, sporting events or re-session may be denied. Rebreed for miscarriage and a reabsorbed litter is at Jackson's Kennel's discretion. We may require a vet​ ​provide​ ​a​ ​letter​ ​stating​ ​the​ ​bitch​ ​is​ ​healthy,​ ​fit​ ​for breeding​ and ​pregnancy​. A rebreeding is at Jackson’s Kennel’s discretion. If the rebreeding fails to take and produce a pregnancy we will offer one of the following; 1) one live cover session, 2) an AI session (we provide the stud only, we will not pay for the AI collection and service), or 3) one time breeding to a different female who meets our requirements with a statement of infertility by the Owner’s established vet. 

    ReBreeding Terms:
    • Pregnancy​ ​was​ confirmed by a veterinarian ​to​ ​have​ ​not​ ​taken​ ​via​ ​a​ ​blood​ ​relaxin test​ ​between​ ​30-40​ ​days​ ​from​ ​first​ ​tie, or have an ultrasound showing the bitch is not pregnant within 50 days from first tie
    • Bitch was fed a balanced pregnancy, puppy or all-life stages kibble not raw or boutique  
    • Bitch is between 2-6 years old 
    • Bitch is on pregnancy safe medications (vitamins, supplements, flea medication, heartworm medication, dewormer, etc)
    • Bitch is current on vaccines, deworming, and parasite prevention including heartworm, flea and tick 
    • Bitch was progesterone/LH Surge tested prior to breeding
    • AI re-breedings will incur the cost of shipping, handling and packaging supplies which is an estimated $200

    Stud service is available for live-cover (natural breeding) or AI (artificial insemination). Vials for AI are collected, prepped and shipped by Jackson’s Kennel’s breeder. Same day shipping is available until 10am Mon-Thursday. Next day shipping is only available when shipped out Mon-Thursday. Shipping requests after Fri cannot be guaranteed for next day arrival. All shipments are sent insulated and with ice packets estimated to last 48 hrs until completely thawed. The semen extender has an average viability lifespan of 7-10 days. For AI shipped semen the bitch owner will be provided with 2 vials of chilled semen with extender. Additional vials may be purchased for a $250 fee per vial. Chilled semen is shipped ASAP one-day shipping Mon-Thurs. Next day may not be available for Fri-Mon. Two-three day shipping is available but not recommended and there is no guarantee with it. The bitch owner is responsible for shipping costs. Shipping is not included in the stud fee and varies based on location. Banked frozen semen can be arranged and shipped; all fees for the collection, banking and transport are billed to the bitch's owner prior to shipping. We do offer fresh side-by-side AI performed by the breeder at the breeder’s/stud owner’s home.

    Bitch housing: Bitches may be brought or transported to Jackson’s Kennel at the bitch’s owner’s expense. Jackson’s Kennel is not responsible for transportation scheduling nor transportation costs. She will need to have enough kibble to last her stay, a proper fitting collar, and a leash. If she arrives without food, a collar, and/or a leash there will be a charge for those missing items. Purchased items will be sent home with her. Raw, refrigerated, and frozen foods are not permitted. She must be current on vaccines including rabies, Lepto, Parvo/Distemper, and Kennel Cough/Bordetella and microchipped. She must have started her heat prior to her stay. She must be able to be walked on a leash and collar. Housed bitches will be kenneled on site and kept isolated from all other dogs except supervised time with the stud. The maximum stay allowed is 2 weeks. After two weeks she must be returned to her owner. This is a courtesy offer; Jackson’s Kennel is not a boarding facility. Should the bitch reject the stud the breeder will call and discuss side-by-side AI. If the bitch shows aggression towards the stud or the breeder/stud owner she will not be permitted to breed with him and will need to go back to her home immediately.

    IN CONSIDERATION OF the risk of injury that exists while participating in STUD SERVICE FOR BITCH(ES) BELONGING TO OWNER (hereinafter the "Activity"); and IN CONSIDERATION OF my desire to participate in said Activity and being given the right to participate in same; I HEREBY, for myself, my heirs, executors, administrators, assigns, or personal representatives (hereinafter collectively, "Releasor," "I", “Owner” or "me", which terms shall also include Releasor's parents or guardian if Releasor is under 18 years of age), knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and \ hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in the Activity; and I HEREBY release and forever discharge KALEE JACKSON, DUSTIN JACKSON AKA JACKSON'S KENNEL, located at 3781 Hyden Rd, Spencer, Indiana 47460, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns (collectively "Releasees"), from any physical or psychological injury that I may suffer as a direct result of my participation in the aforementioned Activity.

    I AM VOLUNTARILY ALLOWING MY DOG(S) TO PARTICIPATE IN THE AFOREMENTIONED ACTIVITY AND I AM PARTICIPATING IN THE ACTIVITY ENTIRELY AT MY AND THEIR OWN RISK. I AM AWARE OF THE RISKS ASSOCIATED WITH PARTICIPATING IN THIS ACTIVITY, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO: PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR OR EMOTIONAL LOSS, AND DEATH. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHERS' NEGLIGENCE, CONDITIONS RELATED TO TRAVEL TO AND FROM THE ACTIVITY, OR FROM CONDITIONS AT THE ACTIVITY LOCATION(S). NONETHELESS, I ASSUME ALL RELATED RISKS, BOTH KNOWN AND UNKNOWN TO ME, OF MY PARTICIPATION IN THIS ACTIVITY.

    I FURTHER AGREE to indemnify, defend and hold harmless the Releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs.

    I FURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Releasees. In the event that I should require medical care or treatment, I authorize Kalee Jackson, Dustin Jackson aka Jackson's Kennel to provide all emergency medical care deemed necessary, including but not limited to, first aid, CPR, the use of AEDs, emergency medical pet transport, and sharing of medical and financial information with medical personnel. I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own Pet Insurance.

    I FURTHER ACKNOWLEDGE that this Activity may involve a test of a person's physical and mental limits and may carry with it the potential for death, serious injury, and property loss. I agree not to participate in the Activity unless I am medically able and properly trained, and I agree to abide by the decision of Kalee Jackson, Dustin Jackson aka Jackson's Kennel official or agent, regarding my approval to participate in the Activity.

    I HEREBY ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS "WAIVER AND RELEASE" AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE Kalee Jackson, Dustin Jackson aka Jackson's Kennel AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT I OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST Kalee Jackson, Dustin Jackson aka Jackson's Kennel FOR PERSONAL INJURY OR PROPERTY DAMAGE. 

    To the extent that statute or case law does not prohibit releases for ordinary negligence, this release also for such negligence on the part of Kalee Jackson, Dustin Jackson aka Jackson's Kennel, its agents, and Employees. I agree that this Release shall be governed for all purposes by Indiana law, without regard to any conflict of law principles. This Release supersedes any and all previous oral or written promises or other Agreements. In the event that any damage to equipment or facilities occurs as a result of my or my family's or my agent's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any such actions of neglect or recklessness.


    THIS WAIVER AND RELEASE OF LIABILITY SHALL REMAIN IN EFFECT FOR THE DURATION OF MY PARTICIPATION IN THE ACTIVITY, DURING THIS INITIAL AND ALL SUBSEQUENT EVENTS OF PARTICIPATION.

    THIS AGREEMENT was entered into at arm's-length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength. Both Participant, and Kalee Jackson, Dustin Jackson aka Jackson's Kennel agree that this agreement is clear and unambiguous as to its terms, and that no other evidence shall be used or admitted to alter or explain the terms of this agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into. In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect. If a court should find that any provision of this agreement to be invalid or unenforceable, but that by limiting said provision it would become valid and enforceable, then said provision shall be deemed to be written, construed and enforced as so limited. ​
    I, THE UNDERSIGNED PARTICIPANT, AFFIRM THAT I AM OF THE AGE OF 18 YEARS OR OLDER, AND THAT I AM FREELY SIGNING THIS AGREEMENT. I CERTIFY THAT I HAVE READ THIS AGREEMENT, THAT I FULLY UNDERSTAND ITS CONTENT AND THAT THIS RELEASE CANNOT BE MODIFIED ORALLY. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND THAT I AM SIGNING IT OF MY OWN FREE WILL.
